1. Overview
Ausmosis is an Australian owned online shopping centre created to help customers find Australian made and Australian owned products, services and business profiles from approved Australian businesses.
All product listings, service listings, customer transactions, business profiles, quote enquiries and vendor activity must comply with these Terms of Service and Ausmosis standards.
2. Eligibility
To use Ausmosis, you must be at least 18 years old and capable of entering into legally binding agreements.
3. Vendor Responsibility
Each vendor is responsible for providing accurate and current information to Ausmosis, including business details, product details, service details, pricing, availability, shipping information, warranty information, contact details and payment information.
Vendors are responsible for supplying products or services as described, fulfilling accepted orders, managing relevant warranty matters, and notifying Ausmosis of any changes to products, services, pricing, availability, shipping, business details or eligibility.
Ausmosis may create, edit, manage and maintain vendor profiles, product listings, service listings, descriptions, images and website content to keep the Ausmosis website clear, consistent and professional.
4. Product Authenticity
Products, services and business profiles listed on Ausmosis must align with Ausmosis requirements, including Australian made and Australian owned standards where applicable.
Vendors must verify and maintain the accuracy of their origin, ownership, product, service and business information. Any listing or profile found to misrepresent its origin, ownership, eligibility, availability or details may be edited, paused or removed from Ausmosis.
5. Intellectual Property
Ausmosis branding, logos, written content, website layout, design elements and original website content are protected by intellectual property law.
Vendors retain ownership of their original product images, descriptions, business information, logos and brand assets. By providing content to Ausmosis, vendors grant Ausmosis permission to use, edit, display and promote that content for the purpose of creating, maintaining and promoting vendor profiles, product listings, service listings, business listings and Ausmosis marketing material.
6. Payments, Commission and Fees
Ausmosis facilitates secure customer checkout through Shopify and approved payment gateways.
Vendors may be subject to an agreed commission on product or service sales generated through Ausmosis. Ausmosis does not charge commission on shipping unless otherwise agreed in writing.
Customers are charged the applicable product price, service price, approved quote amount, shipping, taxes and any other confirmed charges before payment is completed.
Vendor payout timing may depend on payment clearance, order status, delivery status, refund periods, customer issues, and any relevant checks required by Ausmosis.
7. Quote Based Products and Services
Some products and services on Ausmosis are quote based. This may apply where pricing depends on size, product selection, materials, colour, stain, quantity, delivery location, freight, custom requirements, commercial requirements or availability.
Quote based listings are not final fixed price purchases unless Ausmosis has confirmed the final order amount. Final pricing, freight, availability, product details and order requirements must be confirmed before payment is completed.
For quote based products or services, enquiries generated through Ausmosis must remain within the Ausmosis sales pathway unless otherwise agreed in writing.
8. Customer Orders and Enquiries
Customers are responsible for providing accurate order, delivery and contact information when purchasing products, submitting enquiries or requesting quotes through Ausmosis.
Where a customer submits a quote enquiry, Ausmosis or the relevant vendor may contact the customer to confirm product details, pricing, availability, freight, delivery requirements and payment arrangements.
Ausmosis may decline, cancel, pause or review an order or enquiry if information is incomplete, unavailable, inaccurate, unsuitable or unable to be fulfilled.
9. Shipping, Delivery and Fulfilment
Shipping and delivery details may vary depending on the vendor, product, service, delivery location, size, weight, availability and freight requirements.
Vendors are responsible for providing accurate shipping and fulfilment information to Ausmosis. Ausmosis does not charge commission on shipping unless otherwise agreed in writing.
Delivery timeframes are estimates only unless expressly confirmed. Ausmosis is not responsible for delays caused by vendors, freight providers, incorrect customer information, customs, third parties, weather events or circumstances outside our reasonable control.
10. Returns, Refunds and Customer Issues
Returns, refunds, replacements and warranty matters are managed in accordance with Australian Consumer Law, Ausmosis policies and the relevant vendor requirements.
Customers should contact Ausmosis at hello@ausmosis.shop if they have an issue with an order, product, delivery, quote or vendor listed on Ausmosis.
Ausmosis may assist with communication between the customer and vendor, but the vendor remains responsible for supplying products or services as described and meeting applicable consumer law obligations.
11. Account Suspension and Listing Removal
Ausmosis reserves the right to suspend, pause, edit or remove user accounts, vendor accounts, product listings, service listings or business profiles if they breach these Terms, provide inaccurate information, become unavailable, misrepresent eligibility, damage customer trust, or no longer align with Ausmosis standards.
12. Liability Disclaimer
Ausmosis provides an online shopping centre that connects customers with approved Australian businesses, products, services and quote based enquiries.
While Ausmosis manages the website, checkout pathway, business profiles and customer experience, vendors remain responsible for the accuracy of their information, the quality and supply of their products or services, order fulfilment, warranties and any product specific obligations.
To the fullest extent permitted by law, Ausmosis is not liable for delays, damage, loss, product issues, delivery issues, vendor conduct, third party actions or circumstances outside our reasonable control.
13. Changes to These Terms
Ausmosis may update these Terms of Service from time to time. Continued use of the website after updates are published means you accept the revised Terms.
